Statement in accordance with duty to provide information

General

The website and the online shop included on it are operated by philoro EDELMETALLE GmbH (contact details are listed below).

We affirm our commitment to full compliance with the relevant data protection requirements. Your data shall therefore be processed particularly in accordance with the provisions contained in the EU’s General Data Protection Regulation (GDPR), the Austrian Data Protection Act (DSG), and the Austrian Telecommunications Act of 2003 (TKG 2003).

Our employees are obligated to observe the provisions of data protection and maintain the utmost discretion in the intrinsic interests of the customer.

This data privacy statement provides information about the most important aspects of data processing in the context of our online presence:

Purposes of processing

Website

We process your personal data for the following purposes:

  • to make this website available to you, and to further develop and improve it,
  • to be able to generate usage statistics,
  • to identify, prevent, and investigate attacks on our site,
  • to respond to your queries.

The legal basis for the processing of your personal data is our overriding legitimate interest (EU GDPR Art. 6 Par. 1 letter f).

Purchase and sale of precious metals

You can use our website to purchase precious metals from us or sell precious metals to us. We require the following details from you in order to initiate contact and to execute purchase agreements: first and last name, date of birth, telephone number, postal address, email address, and bank details.

If the purchase process is cancelled, we will delete any information we have saved. In the event that a contract is concluded, all data from the contractual relationship shall be stored up until the business or fiscal retention period (7 years) has expired.

Data including name, address, goods purchased, and date of purchase shall be stored beyond this period up until product liability (10 years) has lapsed.

In order to facilitate the purchase process and to enable a contract to be settled at a later stage, the subscriber should know that the his or her IP details will be stored as cookie information, along with the data provided: name, email address, and postal address. Furthermore, in order to execute a contract, the following data will also be stored by us in the case of non-cash transactions: bank details.

The details provided by you are required to fulfil contracts or to implement pre-contractual measures. We cannot conclude the contract with you without this data. Data is transmitted to our data processor for the web shop and our merchandise management system (Kraftwerk Agentur für neue Kommunikation GmbH, 28-32, 1070 Vienna and Future Factory GmbH, Eggenberger Allee 30, 8020 Graz) with the exception of (i) the transmission of bank details to the relevant banks/payment providers for the purpose of debiting or transferring the purchase price, (ii) the transport/shipping company employed by us to deliver the goods, and (iii) our tax consultant for the fulfilment of our fiscal obligations.

Data is processed on the basis of the legal provisions contained in Section 96 Par. 3 of the TKG and Art. 6 Par. 1 letter a (consent), and/or letter b (necessary for performance of contract) of the GDPR.

User profile in the web shop

In the philoro web shop, you have the option of placing orders as a guest, or you may easily create a personal user profile (customer account). In the user profile, you can save your first and last name, your email address (= user name), your postal address, telephone number, and a password of your choosing for future orders. You may change your information at any time after successfully logging in.

After registering, you will receive an email containing a link, which you must click in order to activate your user profile.

Contact with us

If you contact us via the form on the website or by email, the information you provide (address, first and last name, email address are mandatory fields, title and telephone number may be entered on a voluntary basis) will be stored with us for six months for the purpose of processing your query and any follow-up questions. We will not forward these details without your consent.

Newsletter

We also offer you the chance to subscribe to a newsletter. The newsletter is sent via “CleverReach”, a newsletter distribution platform from German provider CleverReach GmbH & Co. KG, Mühlenstraße 43, 26810 Rastede, Germany.

The email addresses of our newsletter recipients, as well as any other data they provide in the context of these notices, are stored on the servers of CleverReach in Germany. CleverReach uses this information to distribute and evaluate the newsletters on our behalf. CleverReach may also use this data, according to the information available to it, in order to optimise or improve its own services; e.g. for the technical optimisation of sending and displaying the newsletter or for economic purposes, in order to determine the country of origin of the recipients. However, CleverReach does not use the information provided by of our newsletter recipients to contact them independently or forward this information to third parties.

We trust in the reliability and the IT/data security of CleverReach. Furthermore, we have concluded a contract with CleverReach for the processing of personal data on our behalf (pursuant to the GDPR). In this agreement, CleverReach is obligated to protect the data of our users, to process it according to the relevant data protection provisions on our behalf, and in particular to ensure that it is not passed on to third parties. The newsletter contains information about our products and about topics relevant to our activities (e.g., event invitations, company news). To register for the newsletter, all one needs is an email address (no names or other personal data required when registering). Registration for the newsletter proceeds according to the “double-opt-in” principle: After registering on our website, you will receive a confirmation mail containing a link. Only by clicking this link are you registered for the newsletter. You can unsubscribe from the newsletter at any time, either by phone or by email (contact details are listed below). You can also unsubscribe by clicking a link that accompanies every newsletter. The withdrawal of consent shall not affect the lawfulness of data processing based on consent before its withdrawal. Registering/unsubscribing is of course free of charge.

A performance measurement of our newsletter marketing activities is also performed via CleverReach, allowing us to assess open and click rates.

Cookies

Our website uses “cookies”. These are small text files that are stored by the browser on your device. They are harmless.

We use cookies to make the services we offer user-friendly. Some cookies remain stored on your device until you delete them. They allow us to identify your browser the next time you pay a visit.

Web analysis

Google Analytics

Our website uses the functions of the web analysis service Google Analytics (Google LLC, Gordon House St. Dublin 4 Ireland). This service uses cookies, which make it possible to analyse the use of the website by your users. The information generated is then transferred to the server of the provider and stored there.

You can prevent this by configuring your browser so that no cookies are stored.

We have concluded a contract with the provider for commissioned data processing.

Your IP address will be recorded but immediately pseudonymised, making it impossible to determine your location except in a very general sense.

Data is processed on the basis of the legal provisions contained in Section 96 Par. 3 of the TKG and Art. 6 Par. 1 letter a (consent) and/or letter f (legitimate interest) of the GDPR.

In the sense intended in the GDPR (legitimate interest), our interest lies in improving the services we offer and our web presence. As the privacy of our users is important to us, the data they provide shall be pseudonymised.

User data shall be retained for a period of 14 months.

Google Remarketing

Our website uses the remarketing function of Google LLC. (Google LLC, Gordon House St. Dublin 4 Ireland). This function is intended to display specific adverts to visitors of our website in the Google advertising network. Your browser stores cookies for this in the respective environment.

You can deactivate Google Remarketing if you so wish (www.google.com/settings/ads).

Your rights in relation to personal data

You are entitled among other things (under the conditions of applicable law), (i) to check whether and we have saved personal information about you, what this information entails, and to receive copies of this data, (ii) to request that personal data belonging to you that is inaccurate or not processed in conformity with the law, be corrected, supplemented, or deleted, (iii) to request that we limit the processing of your personal data, and (iv) under certain circumstances to object to the processing of your personal data or to revoke the consent previously given for its processing, (v) to request data portability, (vi) to identify third parties to which your personal data is transmitted, and (vii) to lodge complaints with the competent authorities (in Austria, this is the data protection authority https://www.dsb.gv.at).
